Back in 2002, when the Transgender Law Center was just starting up, we did a survey of the legal needs of community members. In order to assess those needs, we conducted a survey of transgender people who were living, working, or socializing in San Francisco. One of the best write-in responses we got to our survey was, "Discrimination is not the only reason a transgender person might need free legal help!"
Truer words couldn't have been written. This is especially true for someone who is transgender and HIV+. And while this article is focused on issues related to legal or societal barriers to the expression of gender identity, it isn't meant to mask legal needs based on other forms of bias. Instead, it is simply meant to explain some of the basic legal issues that people who are transgender face.
Transgender legal issues come in many forms. Our current legal system, while undergoing rapid positive change, is not yet fully addressing them. The consequences of this legal reality are stark. For instance, the respondents in the survey mentioned above reported experiencing discrimination in: employment (50%), public accommodation (38%), housing (32%), health care (31%), police interactions (25%), and access to... |
