Alaska high court OKs disclosure of defense expert's tax records.

The Alaska Supreme Court has ruled that plaintiffs in an auto accident case may review the defense expert's income tax records if they suspect bias. The court affirmed a trial court finding that "the income tax returns were relevant and that production of the returns would help clarify any stake the witness might have in the outcome of the case." (Noffke v. Perez, 178 P.3d 1141 (Alaska 2008).)

While the defense won the rest of the evidentiary issues on appeal, Alaska trial attorneys have called the ruling on the tax records a big win for plaintiffs.
