Whenever I see a study of the Supreme Court of Canada by American academics, I feel some trepidation. It is not that they have not developed an impressive arsenal of analytical tools for discussing high court decisions; nor is it that there are not extensive similarities between the two systems. Rather, my concern is that American scholars can be so ready to crank a new set of numbers through their analytical machinery that they downplay the important differences between the systems, with the regretful consequence that Supreme Court Canada (SCC) judges become simply one more set of numbers for the grinding rather than the distinctive personalities that we have come to know and (perhaps) to love. No such worry here: Ostberg and Wetstein have studied the SCC for years, and one searches in vain for sophomoric errors.
