Article Excerpt In a decision that stunned human rights advocates and journalists in Mexico, the nation's high court (Suprema Corte de Justicia de la Nacion, SCJN) ruled that Puebla Gov. Mario Marin Torres could not be charged with violating the rights of journalist Lydia Cacho. The court's 6-4 decision, issued at the end of November, went against the court's own investigation led by Justice Juan Jesus Silva Meza, which concluded that at least 30 public officials, among them Marin, had conspired to harass Cacho.
The court, which decided in a surprise move to take the case in September 2006, issued its decision after more than a year of deliberations (see SourceMex, 2006-09-27). In taking the case, the court followed the recommendations of a special commission (see SourceMex, 2006-04-26).
Speaking for the majority, Justice Margarita Luna Ramos said the only issue the court resolved was that there was no proof that there was a conspiracy between the executive and judicial branches of the Puebla state government to cause harm to Cacho.
