Advertising new drug at issue with Amylin: attorney says FDA is hurting firm's ability to market Symlin.

The authority of the Food and Drug Administration to regulate drug advertising is under national debate, and local biotechnology company Amylin Pharmaceuticals has been in the recent whirlwind.

The company was the sole example set forth in a paper published by the Washington Legal Foundation, which declared that an FDA ban on drug ads as a condition for drug approval is unconstitutional.

The foundation is a nonprofit group of lawyers who fight for free speech, among other issues. A Washington, D.C., attorney specializing in food and drug law wrote the article, titled, "Conditioning FDA Approval on Agreement Not to Advertise Violates Law and Constitution."
