CASE ON POINT: Campbell v. Attanasio, 862 A.2d 1282 -PA (2005)

ISSUE: In this interesting Pennsylvania case, a trial court held a psychiatrist's testimony inadmissible because he was not a specialist in the same field as one of the physician defendants who allegedly was responsible for prescribing intravenous Ativan, which had been banned by the Federal Government. The issue which confronted the trial court as well as the appellate court was whether or not the patient's expert witness required certification as a specialist in the field in which the principle tort-feasor practiced. The principle tort-feasor was a third year resident in internal medicine. Was the plaintiff's expert required to be an expert in the specialty of internal medicine before his testimony could be admitted?
