Fees may impede developers; ruling could stop some building in parts of county.

A decision by the county Board of Supervisors in early April regarding transportation impact fees could end all future commercial and industrial development in unincorporated areas of San Diego County, from Otay Mesa to Fallbrook, according to some local builders.

If the Department of Public Works gains approval for the adoption of its proposed fee program, with the fee schedule as it stands now, "There will be a moratorium on development in the unincorporated parts of the county," said Judd Halenza, a commercial land developer and president of Solana Beach-based Judd Co.

The transportation impact fees--to be levied by the county on developers of commercial, industrial and residential property in order to provide funding for local and regional transportation facilities in the 17 unincorporated areas of the county--are "excessive" and "neither reasonable nor equitable," said Mike McNerney, the president of the National Association of Industrial and Office Properties.

"The cost of certain new development projects would increase by as much 60 percent," he said.
