Last August, the federal judiciary proposed new, restrictive rules on discovery of information from databases, e-mail, and other electronic sources--often called "e-discovery." Powerful corporate interests are pushing hard for adoption of the amendments. We must recognize this effort for what it is: yet another front in the broad, ongoing assault on consumer rights.

Shrinking discovery's reach has been a high priority for corporate counsel and the defense bar for decades, and they have lobbied the federal court rule-makers intensely to make the proposed changes. Business litigants say they need "protection" from "unfair, overbroad" discovery requests from our clients, claiming that complying with them costs corporate defendants inordinate amounts...
