Many current employment-based lawsuits find their impetus arising from acts of discipline by employers against employees. Disgruntled employees often find it easy to attack employers when proper policies and procedures are not followed. When employers do not apply discipline on a consistent level, they give the disgruntled worker an opportunity to assert a claim their discipline or termination was discriminatory in nature. To avoid these types of claims, employers need to develop a consistent, flexible discipline policy for their unique work force.

Create A Flexible Discipline Policy

Discipline policies vary greatly from business to business. Some employers create detailed progressive discipline policies listing each possible employee violation and identifying associated disciplinary measures, such as verbal or written warnings, probation, suspension, counseling, demotion or termination. At the other end of the spectrum, many employers create simple disciplinary procedures, noting simply, the employer retains the right to utilize whatever disciplinary measure is needed under the circumstances.
