Wage-hour litigation continues to plague California employers. Each year, hundreds of cases are filed, and it is not unusual for verdicts or settlements in class action cases to be many millions of dollars.
Despite this disturbing trend, many companies still have misclassification problems, or have policies that may violate other aspects of the wage-hour laws. Some companies worry that changing their practices will be an admission of "guilt" and will invite expensive litigation. To other companies, the laws are complicated and often perplexing, and they are unsure whether problems exist. Unfortunately, wage-hour litigation is here to stay, so uncovering problems and correctly addressing them are the first steps on the road to compliance.
