The Texas Supreme Court recently found that an intermediate care facility owed a duty of care to a woman killed by one of its residents, even though the crime took place while the resident was off the facility's premises.

Anthony Dixon was a resident of Lakewood House, which provides housing and other services to people with mental retardation. By the time he was 14, Dixon had been charged with criminal mischief, evading arrest, theft, and burglary. The Houston juvenile authorities did not prosecute, but instead referred him to the Mental Health and Mental Retardation Authorities of Harris County (MHMR)...
