The effort to limit plaintiffs' rights has intensified since 1995, when Newt Gingrich (R-Ga.) first served as Speaker of the House and attempted to usher in the legislative agenda outlined in the Contract with America. The House leadership had pledged that during the first 100 days of the 104th Congress, it would bring to the House floor the Common Sense Legal Reform Act.

That set of major preemptive tort-law changes opened the floodgates for all the tort "reform" proposals that have since become a staple of floor debate. Surprisingly, though, medical malpractice was not debated as a stand-alone bill until last year, when the House considered limiting patients' rights in H.R. 4600--the Help Efficient, Accessible, Low Cost, Timely Health Care (HEALTH) Act.
