ON DECEMBER 11, 2008, THE PENNSYLVANIA MEDICAL SOCIETY, ON BEHALF OF ITSELF AND ALL OF ITS MEMBERS, INCLUDING MEMBER HOSPITALS, PHYSICIANS AND OTHER HEALTH CARE PROVIDERS, BROUGHT SUIT AGAINST THE STATE DEPARTMENT OF WELFARE. The Medical Society filed a petition in the nature of a complaint for a declaratory judgment and injunctive relief against the State. The Society requested that the State fully fund health care provider payment obligation abatements granted under a program known as the Health Care Provider Retention Program (HCPR) and to refrain from diverting the dedicated funds for budgetary or other purposes.
