In a ruling believed to be the first of its kind, a federal judge in Pennsylvania has ruled that sperm can be a legally defective product. "The sale of sperm is considered a product and is subject to strict liability," wrote Judge Thomas O'Neill Jr. for the state's Eastern District. (Donovan v. Idant Laboratories, 2009 WL 885380 (E.D. Pa. Mar. 31, 2009) .)
