In family law, there exists a uniform principle called the "best interests" standard. The presumption is that judges will award or deny custody, relocation permission, child support, etc. based on the best interests of the child.

Prior to the standard, the precedent in family law was a presumption of maternal custody; not until the 1970s did the idea of joint custody or the best interests standard exist. A group of dedicated fathers developed and pushed the principle into practice.

Today, the best interests standard is a vague postulation that allows considerable latitude and interpretation among judges. With only one in 10 fathers awarded sole custody of their children, we have to consider how the best interests...
